Please read the Terms & Conditions carefully and in their entirety before accessing EatNourishGlow.com.au (hereafter referred to as "the Site").
The Site is maintained and managed by Emma Lisa Lewis (hereafter referred to as "the Practitioner"), a Sole Trader with the ABN 74184814925 operating as an Australian Women's Health Practitioner. The following Terms & Conditions govern your access, your use and your consumption of the content and the Site provided by the Practitioner.
TERMS & CONDITIONS
The following Terms set forth the terms and conditions under which you may use the Site and the services as offered by the Practitioner. The Site offers visitors general health, fitness and well-being information, free and paid digital products, wellness product reviews and the option to purchase a variety of wellness coaching services. By accessing or using the Site and the Practitioner's services, you agree that you have read, understood, and agree to be bound by the following terms.
SITE USE
In order to use the Site and receive the Practitioner’s services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these terms as a binding agreement.
You are not allowed to use the Site or receive the Practitioner's services if doing so is prohibited in your country or under any law or regulation applicable to you. If you do not agree with any site or user terms, you are prohibited from using or accessing the Site.
All content appearing on the Site, is offered “as is” and is for informational purposes only. If you wish to purchase any product or service made available on the Site through either the Shop or Bookings, you agree and understand that it is your responsibility to read the full service or product descriptions, and any health disclaimers before making a decision and commitment to purchase. The Practitioner highly recommends that you check with your GP or treating physician before purchasing the products or services found on the Site, and before trying any new lifestyle changes, coaching or programs.
COMMUNICATION & EMAILS
By subscribing to the Site, or any other opt-in form you may find on the Site, you agree to receive promotional materials from the Practitioner via email or your preferred method of communication.
If you do not wish to receive such promotional materials or notices – please notify the Practitioner immediately in writing addressed to info@eatnourishglow.com.au, with the subject “Opt-out” or use the unsubscribe link found in the footer of all email correspondence. To stop future SMS, please reply with “Opt-out”. Unsubscribing from communications may take up to 48 hours to come into effect.
PAYMENTS
When you purchase or download one of the digital products, service or course from the Site, all payments are processed via Wix and PayPal. By submitting your financial and personal information on the Site during a purchase or booking, you grant the Site and the Practitioner the right to provide the information to these third parties. If you have any concerns before making a payment, please click here to view PayPal’s terms and conditions as payment services are not managed by the Site or the Practitioner.
When making a payment through the Site, you represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct and complete. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
If you elect the payment plan for the 3-Month or 6-Month coaching services at the checkout, you agree that the Site and the Practitioner has permission to automatically charge the amount due on the date(s) agreed upon at checkout. If your payment method fails or is otherwise declined, you will be removed from, or cancelled from having access to, the Site courses, services, or products. Please note, in the event your payment method is declined at any time, you are still responsible for the full cost of your purchase.
PRODUCT DELIVERY & SHIPPING
Upon making a purchase through the Site, you will immediately be directed to a confirmation page and receive email with details of your purchase. In addition you may receive:

a direct download for your digital product either on the Site or in an email

a link to schedule a booking for your product or confirmation of your booking

a link to complete coaching confidentiality agreements or assessment forms

an email confirming your purchase and a follow up email once shipped
Products, coaching services, courses, and event tickets are non-refundable and non-transferable. Where a payment plan option exists, you as the customer agree to all future payments upon making the initial payment.
PRICING & SERVICE CHANGES
The prices the Practitioner charges for using the Site services and products are listed upfront on the website. The Practitioner may, without prior notice, change the services; stop providing the services or any features of the services she offers; or create limits for the services. The Practitioner may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
BOOKING CANCELLATIONS
The Practitioner understands that busy work, motherhood and life schedules can become hectic with unforeseen circumstances. However, in order to honour all bookings and respect each other’s time, the Practitioner expects you to value all appointments by showing up prepared and on time for both initial coaching sessions, on-going coaching and follow up appointments.
If something urgent comes up, you must contact the Practitioner 48 hours in advance to cancel and reschedule your appointment. If 48 hours notice is not provided, you will be charged a booking fee of $50.00.
If the Practitioner must cancel or reschedule a booking, you will be offered the next available session time and in some circumstances, you may be offered compensation at the discretion of the Practitioner.
AFFILIATE / THIRD - PARTY LINKS DISCLOSURE AND DISCLAIMER
At times, the Practitioner may partner with other businesses or affiliate marketing programs whose banners, products and services may be promoted or advertised on the Site such as on the blog. Such promotions may be in exchange for commissions or rewards when users click and purchase those products or services through affiliate links. In some instances, the Practitioner may receive a commission if you make a purchase through an affiliate link (at no extra cost to you).
From time to time, the Practitioner may also mention or recommend other products, services, bloggers, or other websites but no such reference is intended to be an endorsement or statement that such information is accurate. The Practitioner may mention or recommend these based on her own personal experiences. However, it is still your responsibility to conduct your own due diligence to ensure you have obtained complete and accurate information about such products, services, bloggers, and websites.
Affiliate or third party relationships displayed on the Site in no way compromise the integrity of the content, services, and materials being presented to you. At all times, you understand that you are under no obligation to click on affiliate links or purchase those products or services being shared.
Although affiliate links are provided for your convenience, the Practitioner has no control over those external websites, affiliate sites are solely responsible for their own content and information presented. Therefore, I, Emma Lisa (Lewis) of Eat Nourish Glow, and my employees, successors, and partners cannot be held liable or responsible for any content presented on these external websites and any damages resulting from them. This disclosure policy applies to all affiliate links shared on the Site, social media, email newsletters, and other means of communication with you.
OWNERSHIP & INTELLECTUAL PROPERTY
The Site, products, services and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of the Site and the Practitioner unless otherwise stated.
As a Site user, you hereby agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof. At times, stock photography may be used from such sites as Freepik, Pexels, Pixabay, Unsplash under their specific licensing, or purchased with full commercial rights directly from photographer.
If you wish to use, publish, or access any of the Site content, offering(s), or related materials, you must do so by requesting and receiving written permission prior to commencing use of the same by emailing the Practitioner at info@eatnourishglow.com.au.
ASSUMPTION OF RISK
By accessing the Site and the Practitioner's offerings and/or related materials, whether paid or unpaid, you assume all the risk of your access and any subsequent actions you choose to take as a result of the influence, information, or educational materials provided to you.
INDEMNIFACTION
As a Site user, you agree to indemnify and hold harmless the Site and the Practitioner for any direct or indirect loss or conduct incurred as a result of your use of the Site and any related communications, including as a result of any consequences incurred from technological failures such as a payment processor error(s) or system failure(s).
LIMITATION OF LIABALITY
To the maximum extent permitted by applicable law, in no event shall the Site or the Practitioner, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, the Site or the Practitioner assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.
RIGHT TO CHANGE & MODIFY TERMS
The Practitioner reserves the right to modify the Site terms from time to time at their sole discretion. It is the responsibility of you, as a Site user, to review the Site’s Terms & Conditions page periodically. Your continued use of the Site or the Practitioner's service after any such change constitutes your acceptance of the new terms. If you do not agree to any of these terms or any future version of the Site’s terms, do not use or access (or continue to access) the Site or the Practitioner's service.
CODE OF CONDUCT
The Practitioner is an executive member of the © IICT (International Institute for Complementary Therapists) and both ethically and professionally bound by the Code of Conduct found here. The Practitioner is fully insured to practice within their scope of practice and modalities.
